City Approved Ordinance for Installation of Small Cell Wireless Infrastructure

Albany, GA (September 24, 2019) – The Mayor and City Commissioners, approved the proposed ordinance to establish standards for permitting and installing small cell wireless facilities in the City’s rights-of-way.

During the 2019 General Assembly, Senate Bill (SB) 66, known as the “Streamlining Wireless Facilities and Antennas Act” was debated, passed and signed into law by Governor Brian Kemp and scheduled to become effective on October 1, 2019. This Act was designed to provide a more efficient process for wireless companies to install broadband antennas within public rights-of-way. Under the Act, local entities are authorized to enact ordinances to aid in the management of access to rights-of-way for the location of these antennas. The movement towards 5G wireless communications technology necessitates the additional antennas to support a higher volume of data required by the technology.

Nathan Davis, City Attorney, explained, “Companies will have to get an application approved and pay a rental fee that is reoccurring which means reoccurring revenue for the City.”
